Texas Divorce Requirements and Property Division
Texas law sets filing requirements, a statutory waiting period, and rules for dividing the marital estate. How those rules apply depends on the spouses’ residency, property, children, agreements, and disputed issues.
Residency and Waiting Period
Generally, one spouse must have lived in Texas for the preceding six months and in the filing county for the preceding 90 days. A court generally can’t grant a divorce before the 60th day after filing, although limited exceptions may apply in cases involving family violence. This waiting period doesn’t predict how long a particular case will take.
Marital Property Division
Under the Texas Family Code, courts divide the marital estate in a manner they consider “just and right.” This means fair under the circumstances, not necessarily equal. Legal review may include classifying property as separate or community property, identifying debts, assessing valuations, and considering the rights of the spouses and children.
Child Custody, Parenting Time, and Support
Texas uses the term conservatorship for the legal rights and responsibilities associated with raising a child. The child’s best interest is the court’s primary consideration when deciding conservatorship, possession, and access.
A parenting plan may address decision-making authority, the child’s primary residence, possession schedules, and conditions for access. Child support and parenting questions may arise during a divorce or in a separate case involving the parent-child relationship.
How to Prepare for Your Family Law Consultation
You don’t need to have every answer before speaking with us. Start with the immediate issue, the outcome you hope to pursue, and any upcoming hearing or deadline. We’ll listen, ask questions, and identify the information needed to assess your options.
Helpful information may include:
- Existing divorce petitions, custody orders, support orders, or marital agreements
- Income records, account statements, property documents, and debt information
- Parenting schedules, school information, and notes about specific custody concerns
- Relevant communications and a timeline of important events
- Dates for scheduled hearings, responses, or other known deadlines
If anyone is in immediate danger, call 911. Safety concerns or family violence may require urgent legal and protective assistance rather than waiting for a routine consultation.

"He over-delivered and we couldn't be happier."Tyler was Awesome! He kept in contact, answering emails and any questions we had. He let us know the process, and what to expect. He wasn't wrong. He even negotiated with my ex since she was without attorney and dealt with all the crazy with no complaints. His staff was also very professional and friendly, always helpful. I really liked that he had set pricing, not by the hour, so that at each stage we knew what the bill was going to be. That may not work in every case, but for ours it was great.- Rodney S.
