Joint vs. Sole Custody in Texas

Texas doesn't use the term “custody” in the traditional sense. Instead, the state uses a conservatorship framework to define each parent's rights and responsibilities. That said, arrangements generally fall into two broad categories.

In a joint managing conservatorship, parents share the rights and duties of raising the child. This is the most common arrangement, and courts generally favor it unless there is evidence that it wouldn't serve the child's best interests. Joint conservatorship doesn't necessarily mean equal time; one parent typically serves as the primary residence parent.

In a sole managing conservatorship, one parent holds the primary decision-making authority. This arrangement is more common in situations involving a history of family violence, neglect, or other circumstances that make joint conservatorship inappropriate.

Managing vs. Possessory Conservators

In Texas, the parent with greater decision-making authority is called the managing conservator. This parent has the right to make significant decisions about the child's education, healthcare, and religious upbringing. 

The other parent is typically designated the possessory conservator, meaning they retain visitation rights and certain parental rights, but do not hold primary decision-making authority. 

In joint managing conservatorship arrangements, these rights are shared between both parents, though courts will determine specifically how to divide responsibilities.
