Understanding the Different Types of Family Court Orders

Custody & Visitation Orders 

Custody orders provide for conservatorship (custody), possession, or access (visitation) of a child (Tex. Fam. Code § 156.001). Modifications are permitted when they serve the child's best interests and there is a material and substantial change in circumstances. 

Primary Residence Decisions

Courts can modify which parent has the exclusive right to designate a child’s primary residence (Tex. Fam. Code § 156.102). The purpose is to adjust the arrangement to reflect the child’s current needs and living situation.

Temporary Orders 

While a modification case is pending, the court may issue temporary orders affecting conservatorship, possession, or access (Tex. Fam. Code § 156.006). These orders provide stability and protect the child’s welfare during urgent safety concerns.

Orders Following Family Violence Conviction 

If a parent with custody or visitation rights is convicted of or receives deferred adjudication for a family violence offense, the court may modify conservatorship or visitation to protect the family’s safety (Tex. Fam. Code § 156.1045).

Child Support Orders 

Child support orders can be modified when there is a substantial change in circumstances or after a period of at least three years if existing payments differ significantly from state guidelines (Tex. Fam. Code § 156.401). 

When Can Family Court Orders Be Modified?

Modifying an existing arrangement may be necessary to accommodate each family’s changing needs and best interests. However, court orders can only be modified in certain circumstances. Family courts evaluate modification requests carefully to adjust arrangements in a way that reflects the current realities of the family.

A modification is possible when there is a material and substantial change in circumstances since the original order was issued, such as a relocation, career or work schedule changes, or new child safety concerns. Child support orders may only be reviewed after a set period or a substantial change in financial circumstances.

Grounds for Modifying Spousal Maintenance Orders

Spousal maintenance may be terminated when the spouse receiving support dies, remarries, or cohabitates with a significant other. These orders can also be modified if there are material and substantial changes in circumstances after the spousal maintenance was ordered (Tex. Fam. Code § 8.057). How Do Family Courts Handle Relocation Requests in Custody Cases?

Most custody orders include geographic restrictions, which legally limit where the child's primary residence can be located. When a parent wants to move a child to a different city, county, or state, they often need permission from the other parent or the court.

If the move would significantly affect the other parent’s access or visitation, the relocating parent must file a “Suit to Modify the Parent-Child Relationship” (SAPCR) to request approval from the court. 

If the non-relocating parent does not consent, the court may schedule a hearing to reach a decision. Some influencing factors include the reason for the move, the child’s education and social connections, and each parent’s ability to maintain a relationship with the child.
