Understanding Divorce in Tarrant County

Texas is a no-fault divorce state, so most cases are filed on the ground of insupportability, meaning the marriage has broken down beyond repair and neither spouse has to prove wrongdoing. Fault-based grounds, including adultery, cruelty, and abandonment, are still available, and while they aren't required to obtain a divorce, they can affect how a judge decides property division or spousal maintenance.

Grapevine falls within Tarrant County, and family law cases are heard at the Tarrant County Family Law Center in downtown Fort Worth. A few procedural points worth knowing before you file:

  • At least one spouse must have lived in Texas for six months and in Tarrant County for 90 days
  • Texas law requires a minimum 60-day waiting period from filing before a judge can finalize the divorce
  • Contested cases involving significant property or custody disputes typically take considerably longer than that minimum

Dividing Property and Determining Spousal Maintenance

Texas divides community property in a manner the court considers "just and right," which isn't automatically a 50/50 split. Judges can consider several factors, including:

  • Each spouse's earning capacity and education
  • The size of each spouse's separate estate
  • Which parent will have primary custody of the children
  • Fault in the breakup of the marriage, when relevant

Many Grapevine residents work in aviation, hospitality, or corporate roles tied to the DFW Airport corridor, which often means stock options, restricted stock units, bonuses, and other executive compensation factor into a divorce. These assets require careful valuation, and disputes over vesting schedules or the classification of compensation earned before or during the marriage are common.

Spousal maintenance in Texas is more limited than alimony in many other states. It's generally reserved for longer marriages or specific circumstances, such as family violence or a spouse's inability to earn sufficient income, and both the amount and duration are capped by statute.
